Requirements for the EB-2 NIW visa

To be eligible for EB-2 NIW, you must first meet the general EB-2 eligibility requirements. This is the case if you have either a higher degree such as a master's degree or a bachelor's degree with at least five years of relevant, progressive work experience. Alternatively, eligibility can also be demonstrated through exceptional ability – that is, a level of expertise that is significantly above the standard in the respective industry.

Once these basic EB-2 requirements are met, the central question comes into focus: Why would it be advantageous for the U.S. to waive the usual strict requirements – job offer and PERM?

This is where the actual core of the NIW begins. The U.S. authorities examine whether the applicant's planned activity in the U.S. has a significant benefit that goes beyond purely local effects. “National” is understood in the truest sense of the word: it is not enough for a region, a single company, or a municipality to benefit – the activity should be of national importance or at least national relevance. This can refer, for example, to areas such as public health, the environment and climate, education policy, technological innovation, cybersecurity, infrastructure, artificial intelligence, or economic development.

Applying for the EB-2 NIW visa

The application process itself consists of two steps. First, the I-140 petition is submitted, in which all legal arguments and evidence for the NIW are carefully presented. This is the central part of the process and requires a strategically precise presentation of professional qualifications and the national significance of the activity. Once the petition has been approved, the actual green card application follows, either through an adjustment of status within the U.S. or through consular processing abroad.

Since the EB-2 NIW is not tied to an employer, applicants in the U.S. enjoy exceptional freedom. They can switch between different employers, pursue projects, start their own business, or work in scientific collaborations – as long as their work is essentially consistent with what was described in the NIW application. This flexibility is one of the biggest advantages of the NIW over almost all other employment-based green cards.

Families also benefit: spouses and unmarried children under the age of 21 can also obtain a green card under the EB-2 NIW. Spouses can usually apply for a work permit and work in the U.S.
